1. Definitions

The website uni-terra.org is an online service provided by the Dachverband Lehm e.V., the German Association for Building with Earth and is hereafter termed “uni-terra”. Academic institutions, associations and third parties who submit information (“content”) for inclusion on the website are hereafter termed “participants”. Visitors and end users who access information on this website are termed hereafter “visitors”. Participants and visitors are collectively termed as “users”.

2. Provision and terms of use

The uni-terra website, including all information, documents, files, text and graphics contained therein, has been made available for use subject to the terms and conditions detailed below.

uni-terra reserves the right to amend the terms of use and privacy policy at any time without notice. Website visitors and participants are responsible for regularly reviewing these terms and conditions. Continued use of this site following any such changes constitutes acceptance of such changes.

3. Use of the site

The content of the site, that is all information, data, text, photographs, graphics, tags, or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such content originated. Participants agree not to publish any content that is false or misleading; is offensive or obscene; is harassing or invades another’s privacy, or promotes bigotry, racism, hatred or harm against any group or individual; infringes on another’s rights, including but not limited to intellectual property rights; constitutes unsolicited bulk email, i.e. spamming; or violates any applicable laws or regulations. The administrators of uni-terra are entitled to remove or alter any content published on this site without prior notification or without your prior approval. In such case, uni-terra shall have no responsibility of any kind and participants are not entitled to have any indemnification.

4. Participation

Participants must be over 18 years of age. Participants agree not to impersonate any person or entity, or falsely state or otherwise misrepresent an affiliation with a person or entity. Upon registration, and during the full term of participation, participants agree to provide and maintain true, accurate, current and complete information about themselves. If uni-terra has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, uni-terra has the right to suspend or terminate user accounts and refuse any and all current or future use of the service.

5. Registration and user accounts

After successfully finishing the registration process, uni-terra will send participants an e-mail with their username and temporary password to the address specified in the registration process. Upon first login, participants are required to change this password. Participants are responsible for keeping this password confidential, and are fully responsible for all activities that occur under their account. Participants agree to immediately report any unauthorized use of their account. uni-terra shall not be held liable for any loss or damage arising from unauthorized use of accounts.

Participants agree that uni-terra may cancel their user account any time without prior notice. Cause for such cancellation shall include, but not be limited to, (a) breaches of these terms of use, (b) requests by law enforcement agencies, (c) a request by you, (d) technical problems, (e) extended period of inactivity, (f) discontinuance of the site.

6. Copyright or intellectual property infringement

Participants should only upload content to the site that is either their own intellectual property, or licensed for use from the copyright owner. If uni-terra has reasonable grounds to suspect that any content may infringe copyright laws, uni-terra will remove it without obtaining consent and without prior notice. uni-terra may also terminate the accounts of users who repeat infringements.

If visitors or participants believe that their work has been copied in a way that constitutes copyright infringement, or intellectual property rights have been otherwise violated, please report it to the site administrator (address below). A statement should be included detailing (a) that the use of the content is not authorized by the copyright owner, and (b) that you are the copyright or intellectual property owner, or are authorized to act on the copyright or intellectual property owner’s behalf.

7. Ownership and use of submitted content

uni-terra does not claim ownership of submitted content. However, participants grant worldwide, royalty-free and non-exclusive license to use, distribute, reproduce, modify, adapt and publicly display such content on www.uni-terra.org and associated marketing materials used to promote the website. This license does not extend to any third parties (e.g. other participants, visitors or users downloading the content from the site).

In its judgement issued on May 12th 1998 – 312 O 85/98 – “Liability for Links” the Regional Court (Landgericht) of Hamburg decided that any person presenting a link on his website is liable also for the linked page’s content. This may be avoided by expressly dissociating oneself from said content. uni-terra hereby explicitly dissociates itself from the content of any page presented on our website and to the content of all external websites linked to from this website. uni-terra is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites.

8. General practices and limits

Participants acknowledge that if necessary uni-terra may establish general practices and limits concerning the use of the website, including the maximum number of images uploaded (in total and/or in a time frame), the maximum size of images uploaded, maximum size of disk space allotted to one user, the maximum number of times, and the maximum duration of access to the site in a given period of time.

uni-terra undertakes reasonable efforts to ensure continual service. Participants acknowledge that uni-terra has no responsibility or liability for the loss of data stored on its servers.

uni-terra reserves the right to modify these general practices and limits any time.

9. Disclaimer

Except where expressly agreed in writing, uni-terra.org and all content, materials, information and services provided on the website, are provided on an “as is” basis and without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of accuracy, reliability, merchantability, fitness for a particular purpose and non-infringement. uni-terra makes no warranty that the website will meet the requirements of participants or visitors; that the website will be available on an uninterrupted, timely, secure, or error-free basis; that defects will be corrected; that this site is free of viruses or other harmful components; or that the quality of any information, services or other material sourced through the website will meet users’ expectations.

Any content or information obtained through the use of the website is done at the user’s own discretion and risk. uni-terra shall have no responsibility for any damage to computer systems or loss of data that may result from the download of any content, material or information provided.

uni-terra reserves the right to make changes or updates to the website, to discontinue service temporarily or permanently, at any time without notice. Participants acknowledge that uni-terra shall not be liable for any modification or suspension of the website.

10. Limitation of liability

In no event shall uni-terra be liable for any direct, indirect, incidental, special or consequential damages or damages whatsoever resulting from loss of profits, revenue, data or use, incurred by participants, users or any third party, whether in action of contract, negligence or tort, arising from access to, or use of, the site.

11. Indemnity

As a condition of use of this site, the end user agrees to indemnify uni-terra and its representatives and suppliers from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting from the use of this website, including without limitation any claims alleging facts that if true would constitute a breach of these terms and conditions.
